PAC MAN offers on the website www.carousel.be games of chance.

Participation in these games is governed by this contract.

PAC MAN invites you to read it carefully before accepting its terms.

By clicking “I Agree” you acknowledge that you have read all the terms of the Agreement and agree to be bound by them, as well as the detailed rules and instructions of the Software and games of chance. You acknowledge, in particular, your adherence to our Privacy Policy, Bonus Policy, Withdrawal Policy and Fair Play Policy, as set out in this Agreement and any updates thereto.

If you do not agree with the special conditions of this contract, do not click on “I agree” and immediately stop visiting www.carousel.be, download, install or otherwise use the Software, and remove the Software from your computer.

Please ensure that you understand all the terms of this contract. If you have any doubts regarding the rights and obligations under this contract for yourself or PAC MAN, please consult a lawyer prior to registration.

The games of chance provided are in accordance with Belgian law. It is important that you learn about the laws in force in your country of residence before registering. Some gambling may be prohibited by law or subject to special conditions. In the event that any of the games of chance offered by PAC MAN do not comply with the law of your country of residence, PAC MAN cannot be held responsible for them.

1. IDENTIFICATION

PAC MAN is a public limited company incorporated under Belgian law having its registered office at 8490 Jabbeke (Belgium), Gistelsteenweg 519, company number BE 0459.000.733. She holds a B license under Belgian law for the operation of Class II terrestrial games of chance. This license allows him to obtain a B+ license under Belgian law for the operation of a Class II virtual online gaming hall by means of software.

PAC MAN owns and is responsible for the website accessible at www.carousel.be from which the aforementioned virtual gaming hall is open to players.

2. DEFINITIONS

User account: the user account is a personal account opened by a customer (the “Player”) allowing the Player, under special conditions set forth in this Agreement, to access the Software for playing online games of chance; the account may be provisional or permanent.
Agreement: the agreement means all the terms and conditions described in these special conditions of use as well as the detailed rules and instructions of the Software and games of chance available on the Site.
Player: means any person over the age of 21 who has registered on the Site and holds a user account.
Software: means all programs, files, data or other content on www.carousel.be (the “Site”) or linked to the Site allowing the Player to participate in online games.
Username and password: the username and password the Player has
chosen when registering on the Online Gaming Site;
We: PAC MAN SA.
Playthrough: the number of times the bonus amount must be wagered so that the bonus can be withdrawn by the Player. Playthrough is calculated only on the following games: dice slots.
Site: means the website available under the URL www.carousel.be and any other site linked
accessible through links and/or any other path.
You: the Player and, more generally, any user of the Software.
The Parties: means jointly the user of the Software and PAC MAN.

3. Subject of the contract

This Agreement governs access to the Software and participation in the free and/or paid online games available on the Site for which PAC MAN operates under the authority of the Belgian Gaming Commission.

4. Scope and enforceability of the Contract

4.1. Scope

The Agreement forms, together with the detailed rules and instructions of PAC MAN Software and games of chance, an inseparable contractual whole. These constitute the entire agreement of the Parties on the content of the contract between them. In addition, they shall cancel and replace any contracts previously concluded by the Parties. They are applicable to all access to the Software and Player participation from the time it is at stake.

Application of this Agreement is an essential part of the contract between you and PAC MAN. Therefore, these special conditions may only be waived with our prior written consent. The Player shall not be entitled in any way to the application of any other condition whatsoever, these GTU constituting the entire contract between him and PAC MAN.

We reserve the right to change the GTU and, in such event, we undertake to communicate the new version, as well as the closing date thereof to Players via the Site. This will always include the last date on which the GTU was at stake. If this date is not changed when the Player “refreshes” the homepage of the Site using his browser, any changes made after the date mentioned on the Site will not be binding on him.

If, following the refresh process on the homepage, the date of the GTU changes, the new version of the GTU will supersede the previous version and will govern any future Player participation, effective upon posting.

The Parties agree that their relationship will be governed exclusively by the GTU, to the exclusion of any other special conditions available on a site referenced or not by PAC MAN or that references the PAC MAN Site.

4.2. Third-party effectiveness

Any Player participation in the Game offered on the Site requires prior consultation and express acceptance of the Contract by the Player without, however, such acceptance being conditional on a handwritten signature by the Player. In accordance with the provisions of Directives 1999/93/EC of 13 December 1999 and 2000/31/EC of 8 June 2000, and in particular the national legislation transposing them in the Member States, it is recalled that the Player’s registration as specified in Article 5 of the Contract, i.e. when the Player ticks the box preceding the statement “I HAVE READ AND ACCEPT THE SPECIAL CONDITIONS OF USE” constitutes an electronic signature.

This electronic signature shall have the same force and effect as a handwritten signature between the Parties; it shall constitute proof of the Player's knowledge of the Contract, his consent to its registration and his adherence to the Contract which is therefore enforceable against him; and it shall also express the Player's consent to the payment of sums due in execution of the said registration and up to any sums due as a result of the Player's participation in the games available on the Site.

5. INSCRIPTION

5.1. Opening a User Account

Access to the Software and participation in the games available on the Site is reserved for Players who have previously and validly registered on it by completing the registration form published on the Site. This registration procedure involves the obligation for the Player to identify himself by providing a username, email address and password, as well as the following information: name, surname, domicile, nationality, date of birth, country of residence, his national registry number, his mobile number, and his postal address and any other information requested during the online registration procedure.

The Player undertakes, when registering, to provide accurate and complete information and to keep it up to date; he therefore refrains from using registration data that is inaccurate or contrary to public order or morality and from impersonating a third party or choosing a username that causes confusion with another player.

It is forbidden to create multiple user accounts, including from the same computer or different computers and/or the same Internet access. The user account is personal to a Player and may not be transmitted or made available to a third party, by any means, even free of charge.

The games offered on the Site are also reserved for Players, natural persons, aged 21 years and over.

To obtain Player status, the user must meet the following special conditions:

Be a natural person;
At least 21 years of age;
Not to be prohibited from gambling by the Gaming Commission and/or under the law of their country of residence;

In accordance with Belgian legislation in force, the practice of the games offered on the www.carousel.be website is prohibited in particular for magistrates, notaries, bailiffs and members of the police services outside the exercise of their duties.

By creating an account on the www.carousel.be website, in accordance with the procedure referred to in article 3.5 of these terms and conditions, the Player certifies on the honor not to exercise a profession that would violate the provisions of this article.

Have legal capacity and validly subscribe to this Agreement.

Registration is reserved for Players who enjoy full legal capacity under the laws of their country of residence. Players who, for any reason whatsoever, are subject to a protective measure, such as provisional administration, or who are prohibited, for any reason whatsoever, from participating in games, lotteries and casinos, are also not allowed to register for the Game. In any case, any person suffering from incapacity within the meaning of Article 1123 et seq. of the Belgian Civil Code, may in no way register or participate in the Game.

Acceptance of these terms and conditions by checking the box “I HAVE READ AND ACCEPT THE SPECIAL CONDITIONS OF USE” implies that the Player declares to meet the above special conditions.

The information provided when opening the user account must be truthful, complete, accurate and up-to-date by the Player. The Player agrees to inform PAC MAN within thirty (30) days of any changes affecting the data he has provided during registration. Should it become apparent that these special conditions of registration are not/no longer fulfilled, or that the information provided is not or more accurate/sincere/complete/current, PAC MAN reserves the right to deny access to the Software, deny the opening of the User Account and terminate the Player User Account in accordance with Article 8 of this Agreement.

5.2. Registration process

Registration, the process of which is described in this article, opens a User Account.

Registration is done according to the successive steps:

Step 1: Collection of personal details of the User

An input form is presented to the user at the following address:

Unless otherwise stated, all these fields must be completed:

The surname, first name, national registry number, date and place of birth may no longer be changed, except through the Customer Service referred to in Article 10.2.

Step 2: Player ID

Once the personal details have been collected at the end of Step 1, a second input form is presented to the user in order to collect the data from which he will be identified by the Software and during the course of the games available on the Site. All these fields must be completed:

Private login or pseudonym
Password
Confirmation of password

PAC MAN reserves the right to prohibit the use of any pseudonym or username it deems

inappropriate or contrary to public order or good decency.

The password must be entered by the Player each time he logs into the Site in order to be identified by PAC MAN. Only the login ID can be pre-established.

Only the pseudonym will be visible to other Users, the password remaining strictly

confidential and personal to the user.

PAC MAN recommends that the user choose a pseudonym separate from his first and last name. Once PAC MAN has validated the pseudonym chosen by the Player, it will no longer be possible to change.

PAC MAN is under no obligation to retain Player passwords and identifiers, which are solely responsible for them.

In case of forgetting your password, the User must click on the link “FORGOTTEN PASSWORD? » on the homepage of the Site and enter the email address linked to his user account

PAC MAN will then email him a link to generate a new password.

In the event of forgetting, losing or stealing the login ID, the user is required to send an email to PAC MAN at [email protected]. PAC MAN will take all necessary measures to restore Player access to his account, after verification of his identity.

Step 3: Player statements

The Player is asked to indicate whether he wishes to receive commercial information, such as advertisements, from PAC MAN or its partners.

By ticking the “YES” box, the Player agrees to receive the above business information.

The user also certifies on the honor:

o that he has read and accepted all the terms and conditions of the Contract;

o is at least 21 years of age.

Without this honorary certification, he cannot continue his registration.

By clicking on the validation button, the certification input box on the honor is controlled. In case of forgetting or inconsistency, the error is indicated. In such a case, the registration procedure shall be terminated. If not, the Player is invited to continue the registration process in step 4.

Step 4: Validation of user account email

The Player can now access his “user account” area, as well as the applications of

online games.

In order to validate his email address and activate the withdrawal function of the Site, an email will be sent to the Player, having just completed the registration form detailed in the steps stated above, with a hyperlink. The player must click on this link which will redirect him on the website www.carousel.be to a page informing him that his account has been validated.

5.3. Access, processing and management of Player personal details

A. Access by the Player

In accordance with the applicable European and national legal provisions (2), the Player may exercise his right of access to the file and his right to rectify his information by accessing the “Personal Details” section of the “My Account” section. By clicking on the “MY ACCOUNT” tab on the homepage of the site, the Player can access his personal information at any time.

The Player can change his password by entering the old password and entering the new password twice. All other modifications require the intervention of Customer Service referred to in Article 10.2.

He may exercise his right of deletion for information concerning him by contacting the Customer Service referred to in Article 10.2 or by mail to the address PAC MAN mentioned in Article 1.

Any request to exercise the right of access or deletion can also be made in writing, and be signed by the requester, include the address to which the response must be addressed, be accompanied by proof of his identity, and sent by email to the address [email protected]. PAC MAN will respond to your request within a maximum of one (1) month of receipt, provided it is sufficiently precise and contains all the elements necessary to respond to your request, failing which PAC MAN will invite you to complete.

B. Processing and use of Player personal details

In accordance with the same legal provisions mentioned above, the processing of personal information collected on the Site has been the subject of a declaration under the number VT005041150 to the Privacy Commission. The data controller is PAC MAN, which is registered as the controller of personal data with the Privacy Commission. The person within the company,

responsible for the processing of personal data and for responding to Players’ questions on this matter can be reached at [email protected].

All information set out in sections 5.1 and 5.2. is personal and confidential. PAC MAN undertakes to treat them as such.

Only the Player’s personal details are accessible to PAC MAN employees and service providers, whose task is to operate the Site or render the Services. The recipient of the data is PAC MAN.

The personal details will only be processed by PAC MAN’s internal services for the processing of registrations and Players’ participation in the games, their participation in the discussion areas, the possible sending of newsletters (if and to the extent that the Player has consented to it during registration), or for the purpose of strengthening and personalizing communication in particular by newsletters / emails as well as part of the personalization of the Site and the proper functioning of the games, the Players’ participation in the games and discussion areas on the Site and for the possible sending of newsletters, according to the choices made during registration.

PAC MAN shall not transfer any personal details, free of charge or otherwise, to any third party, without prejudice to the Player’s consent to the use of his personal details in accordance with Article 5.2.A, Step 3.

PAC MAN may also, but after obtaining the Player’s individual, prior and explicit consent, transmit all or part of his personal details for the benefit of his contractual partners, for canvassing purposes, in particular commercial. The Player will thus have the right to oppose, free of charge and free of charge, the use of his personal details for prospecting purposes, in particular commercial, by PAC MAN or its business partners.

The Player declares that he is informed and agrees that PAC MAN will also provide consolidated statistics relating to his Players, games, trading patterns and information provided on the Site to partners, but these statistics do not contain any personal data.

The Player further agrees that PAC MAN reproduces on its Site, as well as with its partners, its pseudonym when the user wins a tournament, a win and/or prize.

Some web pages of the Site may sometimes contain electronic images or "web beacons", which make it possible to count the number of visitors to the page. These web beacons can be used with some of PAC MAN’s partners, in particular to measure and improve the effectiveness of certain actions. The information obtained through these tags only allows us to collect statistics on the use of certain pages of the Site, in order to better serve Players.

The Player expressly and specifically declares consent to these uses.

PAC MAN reserves the right to transmit the personal details provided by the user, either to comply with a legal obligation, or pursuant to a judicial or administrative decision. The Player declares that he is aware of and agrees that this data will be transmitted to the Gaming Commission, in accordance with the legal requirement.

This article is not intended to prevent the transfer of PAC MAN’s activities to a third party.

C. Retention of personal data

The user's personal information is stored on PAC MAN's game servers. No other third party may have access to this information.

All this data is stored in encrypted and secure files. In the event that a third party accesses these files, PAC MAN undertakes to make every effort to ensure that the information on these files remains unreadable.

These data will be kept until the closure of the user’s account, with the exception of data necessary to establish proof of a right or contract which may be archived by PAC MAN for a longer period.

The data may be communicated to PAC MAN service providers for the operation of the storage service.

In any case, in the event of the closure of a registration as a result of fraudulent use of the games or the Site, PAC MAN reserves the right to retain all the data associated with the deleted account, in particular and without limitation, its connection parameters (nickname, password, IP address, contact details) and the history of its activity (games played, game statistics, withdrawal requests,...).

D. Player responsibility

It is the Player’s responsibility to ensure strict respect for the confidentiality of his personal details and, in particular, his password.

The storage, use and transmission of the Player’s username and password are the sole responsibility of the Player. In particular, the Player declares that he is aware of the insecurity inherent in the use of the function of automatic storage of the connection coordinates that his computer system may allow, and declares that he assumes full responsibility for the use and possible consequences of such a function.

PAC MAN advises the user not to communicate his/her data by email or fax without PAC MAN having expressly requested it. It is up to the user to verify beforehand that PAC MAN is indeed at the origin of such requests.

Any use of the User ID and password is presumed to have been made or duly authorized by the Player. Consequently, PAC MAN shall in no way be held liable for the consequences detrimental to the Player of the illegal, fraudulent or misuse of login details and access to the Site by a third party not expressly authorized by the Player. The Player will also be solely responsible for the inability of the Player to access his account in the event of forgetting his login details (for which recovery procedures exist (Article 5(3)).

Any illegal use of Player ID or password must be reported to PAC MAN as soon as possible so that PAC MAN can stop the effects of such fraudulent use after registration of Player objection. The same applies if the Player suspects that any of their login details are no longer confidential. Notification by the Player of such unauthorized use does not, however, give rise to any obligation on the part of PAC MAN and does not evade Player liability, in the event that the Promoter fails to protect itself from the consequences of such use.

PAC MAN reserves the right to require the user to change his user ID and password if it considers that they no longer provide adequate security. Similarly, PAC MAN reserves the right, in accordance with article 8 of this contract, to suspend, temporarily or permanently, the user’s access to the Site using his username and password if it suspects misuse of these and, more generally, in case of non-compliance with this Agreement.

PAC MAN shall not be liable in any event for any misuse case of a Player’s username or password. Similarly, PAC MAN cannot in any way be held responsible for the consequences of the lack of personalization of its password by the user.

6. How to use the games

6.1. Compliance with legal regulations on access to and participation in the games

The Player undertakes, by registering, to respect the Belgian laws as well as the laws in force in his country of residence. They are prohibited from participating in the Game if they have not reached the age of 21, have no full legal capacity, are prohibited from playing or are prohibited by the laws of their country of residence or are subject to any measure of prohibition against playing.

The Player is authorized, by registration in accordance with Article 5 of this Agreement, to use the Site, the Software and the Games for non-commercial purposes. This right is granted to him on a personal, non-exclusive and non-transferable basis to use the Software, subject to compliance with this Agreement and in particular the following special conditions:

a. All the information contained in the registration form you submitted to PAC MAN is true, sincere, accurate, current and complete, and corresponds to the data shown on your identity card and bank identification documents used for deposits and receipts.

b. Participation in the games is exclusively via the Site, Player ID and password. The Site is accessible via any computer hardware, including a computer, mobile phone or any other medium that allows connection to the Internet (Smartphones, iPhones, iPod touch, game consoles, SmartTV, etc.).

The Player declares to be informed that access to the Site and participation in the Game requires that he has at his disposal an Internet connection that makes possible access to the Site. It releases PAC MAN from any liability in the event that access to the Site and participation in the Game would be impossible due to a case of force majeure or use by the Player of equipment inadequate or configured by a third party in such a way that the Player does not have access to the Site.

The Player warrants to PAC MAN that the equipment used is free from defects that may affect the proper functioning of the Site, the Software and the Games. To this end, it undertakes to use updated anti-virus software.

c. The use of the Software, the Site and the Games is granted to the only registered user beforehand. You may not authorize any third party to use your account, password or identity to access the Software, Site or Games. No complaint will be accepted by PAC MAN regarding any gaming activity performed on your account by any third party.

PAC MAN is not responsible for the fraudulent or improper use of a user account or stolen debit or credit cards, even if such improper or fraudulent use of the user account or the theft of such cards has been reported to PAC MAN. The same applies if the User Player forgets, misplaces or loses his password.

The Player therefore remains entirely responsible for the use by a third party, authorized by the Player or not, of his computer equipment, his email address, username and/or password or with the number of his credit card. It will comply with the requirement of Article 5.3.D of this contract and will keep PAC MAN harmless from any use by a third party of its username or password. The Player undertakes to take all appropriate measures to maintain their confidentiality. For this purpose, he will in particular make sure to log out of his account at the end of each session.

The Player will also ensure that the links through which he participates in the Game direct him to the Site and the web address www.carousel.be in particular. Any participation in games outside the Site and, in particular through a web address other than www.carousel.be is deemed non-existent; the Player will keep PAC MAN harmless from the consequences thereof.

d. PAC MAN reserves the discretion to limit or refuse any bets or stakes made by the user or through their user account.

e. The Player agrees not to commit any act or conduct that may cause damage to- or harm the reputation of PAC MAN, the Site, the Software or the games or other Players, as well as the proper functioning of the Software, the Site and the games.

It is forbidden, by any means whatsoever, to modify or attempt to modify the devices of the proposed games, in particular to modify the results or any element determining the outcome of a game and the winners of a game.

The Player further agrees not to use or attempt to use stochastic calculation (martingale) or any software that is endowed with artificial intelligence in connection with the use of the Software or games. In the event that PAC MAN reasonably believes that you have modified or attempted to modify the devices of the games offered, used or attempted to use a martingale or an artificial intelligence product with our Service or Software, PAC MAN reserves the right to terminate or block your account immediately, not to refund the amount credited to your account, and to prohibit you from accessing all other websites, services and software that PAC MAN would offer, without recourse of any kind.

The Player also undertakes, and more generally:

to refrain, by any means or instruments whatsoever, from any act of manipulation of the Site, the Software or the Games that may affect its probabilities of winning or those of other Players or of losses of other Players.
not to use robots, research programs or any other manual or automatic means to find, index, store, record or reproduce, the structure or presentation of the Site, software or games.
not restrict, usurp or prohibit access to the Site, the Software and the Game to other Players, by any means or instruments, including through the use of any software or any act of piracy, hijacking or modification of all or part of the Site.
not to use the Site, the Software or the Games, or any part of their content, for any illegal purpose or to the detriment of PAC MAN’s interests, other Players or third parties.

f. The Player represents and warrants that he has read, fully understands, accepts the rules specific to games of chance available on the Site.

In particular, the Player declares to be aware and accept that by playing the games of chance available on the Site, he may not win but also lose money. He undertakes to bear alone the consequences of any financial loss and abandons recourse on this count against PAC MAN. This applies in particular when the Player manages, on his own initiative or due to a malfunction of the site, to suffer a loss greater than the hourly loss regulated by the Belgian Gaming Commission.

The Player represents and warrants to PAC MAN that the funds he uses to play on the Site are not of illegal origin, and agrees not to use the Service for the purpose of transferring funds, or engaging in any illicit or fraudulent activity, or any prohibited transaction (including money laundering), in accordance with the laws of all jurisdictions under which it depends.

The Player also acknowledges PAC MAN’s right to request proof of a customer’s deposit for all alternative payments at any time (e.g., Click2Pay, MoneyBookers and Neteller). PAC MAN reserves the right to request the bank account number of its customers without any reason.

g. You certify that you will not force or attempt to force or otherwise circumvent PAC MAN’s security measures, including registration procedures.

The user agrees to use the Site, as well as any other element attached to it and/or incorporated, such as in particular: hypertext links, software, database, editorial content, graphics chart..., in accordance with the provisions of this Agreement and for the only non-commercial gaming purposes offered by PAC MAN. If PAC MAN has any doubt as to compliance with this clause, PAC MAN reserves the right to terminate or block your account immediately, not to refund the amount credited to your account, and to prohibit you from accessing all other Websites, Service and Software that PAC MAN offers, without recourse of any kind.

h. The Player declares that he is informed that any money linked to his user account will in no case be interest-bearing; he does not make any claim in this regard, regardless of the period during which the money remained linked to his user account.

i. The Player shall not participate in any games with a user account of another Player or using the same computer and/or Internet connection as that of another Player.

It also prohibits any abuse of the possibility of opening several accounts per Player. Each Player is allowed to open a single Player account.

In the event PAC MAN discovers that a customer has more than one player account PAC MAN reserves the right to block all user accounts, including but is not limited to all transactions related to user accounts, until that the problem is fully solved.

You certify that you will not abuse the opportunity to open accounts in order to benefit from the credits, bonuses and promotions offered by PAC MAN. PAC MAN reserves the right, in its sole discretion, to immediately terminate or block user accounts created for these purposes and their transactions in case you misuse cases related to bonus credits and/or promotions offered by PAC MAN.

j. The Player undertakes to comply with any tax obligations he may have. He shall be solely and fully liable and liable for the declaration, registration, payment, accounting for taxes or any other extraordinary tax or charge which he would be legally liable to any tax authority in right of his winnings, if any.

k. The Player shall not, without PAC MAN’s consent, reference the Site, the Software or the games, on any medium whatsoever, and in particular, refrain from advertising it, for example by inserting hypertext links or sending unsolicited emails or messages to Players or third parties users.

l. The Player agrees not to collect or collect any information about Players or more generally any third party who consult the Site www.carousel.be.

m. The Player declares to be informed that PAC MAN may modify the content of the Site, the Software and the games, without notice. It therefore undertakes to take note of the said amendments as soon as they are brought to its attention by PAC MAN. For this purpose, any changes will be communicated to Players through the NEWS section or any other means.

n. The Player is free to access and participate in the dialogue areas offered on the Site (real-time chat, forum) subject to compliance with the legislation in force and this Agreement.

The User undertakes to respect the elementary rules of good conduct, politeness, and courtesy which, in particular:

Remain courteous and polite to those who speak;
Avoid personal attacks;
With particular reference to the forum:

* not posting the same message repeatedly in multiple topics/forums (multipost);

* Try to use the "Search" function before creating a new topic that might already exist on the forum.

Players are strictly prohibited from disseminating or disseminating, or contributing to the dissemination, of hateful, racist, anti-Semitic, xenophobic, homophobic, defamatory, infringing public order and morality or more generally disparaging or unpleasant, on any medium, including in chat rooms, about Players, the Site, the Game or the Promoter.

Messages that are contrary to the spirit of the Site, such as, but not limited to, statements or opinions of a political or religious nature, abusive, excessive, inappropriate, attempting to mislead other Players about the rules of the game or by impersonating others and more specifically by posing as an employee, staff member, partner or affiliate of PAC MAN, or any other company of which it is a part, a moderator, or a host, are also prohibited.

Similarly, the user will not impersonate another user, celebrity, or communicate under a false name, quality or pseudonym, or lie about his or her status as an adult or minor, or upload, post, transmit by any means, any content affected by computer viruses, or any other code, or software designed to interfere, falsify, interrupt, destroy or limit the normal operation or functionality of the Site, Software or Games.

PAC MAN reserves the right to remove from forums and discussion areas any message that violates this provision.

It is expressly agreed that each Player remains solely responsible for the content of the messages they post on the Chat Rooms. PAC MAN shall in no way be held responsible for the content, in particular the illegality of the content under the applicable regulations, any loss or damage resulting from the use of any content posted, transmitted by instant message or in any other way through the Discussion Spaces or forums. In the event that PAC MAN’s liability is sought for a breach by the user of his obligations under this provision or the legal and regulatory provisions in force, PAC MAN reserves the right to call the user as a warranty.

6.2. WITHDRAWALS, BETS, BONUSES

Subject to compliance with all the provisions of this Agreement, PAC MAN undertakes to execute at the Players’ first request their request for withdrawal of winnings, provided and provided that the balance of the user account is positive.

PAC MAN may temporarily offer bonuses allowing Players to play without prior deposit:
Any winnings obtained from the stake of bonuses offered by PAC MAN can only be withdrawn by depositing an amount equivalent to the amount of the winnings, in accordance with the Playthrough. Otherwise, any withdrawal request, while Playthrough is not reached, will be executed by PAC MAN, but will result in the loss of bonuses.
Player bonuses are personal and cannot be passed on to any other Player or third party. Multiple Players are not allowed to pool their winnings, bonuses or losses.
Cash bets must be played prior to any bonus.
Bonuses are always offered on a temporary basis; these offers can be withdrawn at any time by PAC MAN.
ABUSE OF BONUS USE: Repetitive withdrawal by a Player of bonuses offered on the first deposit or in subsequent promotions by deposit (10% - 100% bonus), when the Player has made such withdrawal and then participates in the games only with the chips offered by PAC MAN, is considered abusive.

Any abusive and repetitive use of PAC MAN promotions during deposits (including but not limited to our partners’ promotions for payments, certificates and/or reward certificates) by depositing only a minimum amount in order to be able to play with bonuses may cause PAC MAN, in its sole discretion, and without recourse of any kind, to label the user “bonus abuser”, or to block and/or terminate the user account and any transaction related thereto.

PAC MAN reserves the right to catalogue a Player who has abused bonuses in its sole discretion. Once PAC MAN declares a user to be a “bonus abuser”, that user will no longer be eligible for any promotional bonus.

6.3. Pre-eminence of PAC MAN results

In the event of discrepancies between the result presented on the Site and the result recorded, directly or indirectly by PAC MAN, in particular on its computer server through the Software, the latter must always prevail.

The Player acknowledges and agrees that only PAC MAN computer files shall be authentic.

Consequently, only data and records obtained and/or stored directly or indirectly by PAC MAN will be considered as proof of the existence and content of the rights and obligations of PAC MAN and the Player, regardless of the medium.

6.4. Transactions

A. Management of the user account by the Player

The use of the User Account by the Player is strictly limited to his participation in the online games available on the Site. The Player’s replenishment of the User Account may only be intended for this purpose, to the exclusion of any other use, in particular as a bank account.

PAC MAN undertakes to pay all winnings obtained by the Player, subject to the

compliance with this Agreement.

Withdrawal of available assets from the Players’ user account is subject to the existence and maintenance of a valid user account. PAC MAN also reserves the right to ask the player for any information or documents it deems necessary to validate any deposits or withdrawals.

The payment of any money will only be executed by PAC MAN to the extent that the Player is not liable for any money to PAC MAN and after controlling the proper conduct of the game, the absence of any cheating, fraud and no error of the Software or human error that has resulted in an unjustified gain or loss for a Player.

PAC MAN does not take any commission or fees of any kind on deposits or withdrawals, regardless of the payment method. However, PAC MAN reserves the right to apply a 15% administration fee to transactions (withdrawals and deposits) that are not solely for the purpose of participation in the games (in particular in the case of consecutive deposits and withdrawals without stakes or any misuse of the user account or bonuses, for example).

The Player declares to be aware that, depending on the method of payment used, fees may be charged to him or her by his or her banking institution or payment provider. PAC MAN cannot be held responsible for this, the Player being obliged to inquire beforehand with his financial institution or payment provider about any transaction fees that they may charge him.

The Player declares to be aware that all financial transactions are subject to the usual banking deadlines. It is also the Player’s responsibility to verify that all information necessary to complete the transaction has been provided to PAC MAN.

PAC MAN can under no circumstances be held liable in case of payment made by it

into the bank account of a Player who has allegedly been hacked.

B. Deposit limits

Two types of limits are available on the Site (a) the default deposit limit and (b) personal deposit limits. The most restrictive limit will apply to Players.

a) Default deposit limit

Pursuant to the Royal Decree of 25 October 2018 on the operating procedures of games of chance and bets operated using information company instruments and the Royal Decree of 19 June 2022 determining the consultation procedures of the Belgian Central Individual Credit Register by the Gaming Commission and amending the provisions relating to the limitation of online games of chance, the Player is informed of the imposition of a weekly default deposit limit under the said Royal Decree, preventing him from depositing more than 200 euros per week into his Player account. The Player has the option to remove the default deposit limit with the permission of the Gaming Commission. It is, however, advisable for the Player to determine his game limits on the basis of his financial situation and to always remain within the limits set by himself.

To remove the default limit, the Player must go to the Player account settings or the Deposits page and request the withdrawal of the default deposit limit.

PAC MAN shall inform the Gaming Commission of this request immediately and in electronic form.

Within 72 hours (three days) of receipt of the request, the Gaming Commission informs the Belgian Central Individual Credit Register whether such a request can be authorized after it has asked the National Bank electronically whether the Player is known to be in default in the Belgian Central Individual Credit Register.

The increase cannot be granted to Players who are known to be in default in the file of the Belgian Central Individual Credit Register of the National Bank of Belgium. The Player will be notified by PAC MAN of the Commission's refusal.

The Player is also informed that PAC MAN may be legally obliged to cancel the increase in the default deposit limit requested by the Player and initially applied following the notification by the Gaming Commission of the Player’s registration in the Belgian Central Individual Credit Register as being in default.

b) Personal deposit limits

As part of responsible gambling awareness and with a view to protecting the Player by PAC MAN, the Player may at any time set more restrictive personal deposit limits for all games of chance and bets in which he participates on the Site. If the Player does not set a personal limit after the withdrawal of the default limit, a limit of 2000€ per week will be imposed on the Player.

To do this, the Player goes to the Player account settings where he has the possibility to set deposit limits for periods of 24 hours, 7 days or 1 month. A decrease in the Player’s personal deposit limits will have immediate effect.

In the event of an increase in a personal deposit limit by the Player, the Player is informed and agrees without reservation that he may only play with this increased limit after 72 hours following such an increase. Then, the Player can choose to lower their personal deposit limit or re-establish their default deposit limit by going to their Player account settings.

C. Player responsibility

PAC MAN uses private/public encryption methods to ensure, to the best of its ability, the confidentiality of Players’ passwords and secure access to the Software and Games. However, the Player is fully responsible for the proper functioning of his user account and the confidentiality of his password.

The Player shall not use the payment methods or user account of any third party or other Player, even with the latter’s consent.

He expressly undertakes not to oppose or cancel with his bank, for any reason whatsoever, any payment of amounts due to PAC MAN. The same applies to any money credited to his account by his debit card. In other words, the Player irrevocably and definitively waives to oppose or refuse any payment of amounts due to PAC MAN.

In addition, the Player agrees to PAC MAN having the right to withdraw from the user account any sums he may have improperly received as a result of fraud or malfunction of the Site or the games.

The Player agrees to indemnify PAC MAN for any loss it may incur in connection with the Player’s payments or non-payments or the misuse or misuse of its account.

If PAC MAN suspects that a Player is under the minimum age to play, they will return any money wagered to them as soon as possible. In addition, any winnings received by the user will be confiscated until the user has provided irrefutable proof of the minimum age required to play.

D. Verification

The Player agrees that:

PAC MAN checks the creditworthiness of a Player, with the assistance of financial institutions and third-party payment providers, based on the information that will be provided by that user at the time of registration.
PAC MAN uses electronic payment processors of third-party companies and/or financial institutions that manage payments that are made by the user in connection with their use of the Site, Software and Games.
PAC MAN blocks the Player’s user account for suspected fraud, cheating or any use of the Site or games contrary to this Agreement;
PAC MAN objects to the use of certain debit cards related to illegal activity, fraud, cheating or non-compliance with this Agreement.
PAC MAN may ask the Player for bank account details and financial transactions as part of the use of the Site at the Player’s initiative.

PAC MAN shall not be liable for any fraudulent or improper use of a user account or stolen debit or credit cards, even if such improper or fraudulent use of the user account or the theft of such cards has been reported to PAC MAN.

6.5. Responsibility of PAC MAN

PAC MAN is committed to doing everything possible to ensure access to the Site, the Software and the games as a diligent professional.

PAC MAN undertakes that the use of the Internet Gaming Software will ensure the Player a fair chance of winnings through the Random Number Generator Software (RNG: Random Number Generator).

PAC MAN strives to ensure the availability of the Site, Software and games 24 hours a day, 7 days a week.

In order to connect to the Site, the Player acknowledges and agrees that he must have hardware and software equipment, as well as an Internet connection compatible with the special conditions of supply of games offered by the Site. To do this, PAC MAN recommends having the Acrobat Flash Player software, as well as the following:

Hardware and operating system:

PC: Windows XP and later MacIntosh: Mac OS X and later

Browser Software: IE 8 and later with Javascript enabled Firefox 5.0 and later with Javascript enabled Connection Type: ADSL 512 minimum.

If the User does not have this minimum configuration, he takes the risk of not being able to benefit from the Services offered online by the Company.

The Player is aware that access to the Site, the Software and the Games is impeded or temporarily interrupted, for example due to maintenance operations, upgrades and/or updates of the Site, the Software, or games or repairs thereto as a result of piracy or other circumstances beyond PAC MAN’s control, such as:

a malfunction of the Internet network preventing the proper running and/or functioning of one or more games offered on the Site or more generally access to the Site, the Software and the games;
failure of receiving equipment or communication lines;
a routing problem;
a computer virus or bug, a technical, hardware or software anomaly or failure of any kind.

PAC MAN undertakes to take all reasonable measures to limit such disturbances, insofar as they are attributable to it. The Player therefore acknowledges and agrees that PAC MAN assumes no responsibility for any unavailability, suspension or interruption of the Site or Services.

PAC MAN cannot, however, under any circumstances, be held liable for any damage or inconvenience, of any kind, direct or indirect, foreseeable or unpredictable, relating to the use of the Site, the Software or the games, including but not limited to:

any missed gain, loss of opportunity, cost of obtaining a service or a
alternative technology;
any consequences of the above circumstances;
any consequences of an incidental case or a similar circumstance

PAC MAN shall also not be liable if, for any reason beyond its control, one or more of the games or services are modified, postponed or cancelled. Any change or evolution of the content of the Site may result in a temporary stake and/or unavailability of the Site, which in no way engages the responsibility of PAC MAN.

Similarly, PAC MAN reserves the right to discontinue or suspend one or more of the games or services offered on the Site, at any time and without notice, without having to justify the reason or reason. In this case, PAC MAN will not be liable in any way and users will not be entitled to any compensation whatsoever.

In the event of a Player’s complaint due to a lack of availability of the Site, the Software or a game, PAC MAN reserves the absolute right to request a screenshot, without this request engaging PAC MAN’s responsibility.

PAC MAN may offer simple links to other third-party websites on the Site. In such a case, the links are provided for information purposes only. PAC MAN does not control the content, current or future, of these third-party websites, any access to these sites being made under the sole responsibility of the user and at his own risk. PAC MAN accepts no responsibility for the content, legality or availability of third-party sites. The Player acknowledges that PAC MAN assumes no responsibility of any kind for any loss or damage that may be caused by accessing or browsing these third-party sites. PAC MAN undertakes, however, to dereference third party websites whose illegality has been brought to its attention, by any means and in particular by simple complaint made by email.

Finally, the Player holds PAC MAN harmless from any damage or inconvenience, of any kind, direct or indirect, foreseeable or unforeseeable, that the Player or a third party suffers as a result of misuse or improper use of the Site, Software or Games, by a Player or a third party, including but not limited to damages related to pecuniary loss, lack of winnings, loss of data, damage to property or person.

In any event, should PAC MAN be held liable for any reason or ground, including negligence, damage or inconvenience of any kind, direct or indirect, foreseeable or unforeseeable, including but not limited to damage resulting from gambling (medical care, loss of employment, hospital expenses, etc.), the maximum amount of compensation to which PAC MAN may be liable shall be limited to the lesser of:

1) the amount of commissions received by PAC MAN in relation to the player’s account during the last three months preceding the complaint;

2) or the sum of 500 euros (five hundred euros).

6.6. LACK OF GUARANTEE

IN THE EVENT OF ANY ERROR IN THE SYSTEMS OR MEANS OF COMMUNICATION DUE TO VIRUSES OR BUGS IN CONNECTION WITH THE SETTLEMENT OF ACCOUNTS OR ANY OTHER SETTINGS OR COMPONENTS OF THE SOFTWARE, WE WILL NOT BE HELD UNDER ANY CIRCUMSTANCES LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DAMAGES, COSTS, EXPENSES, LOSSES OR CLAIMS CAUSED BY SUCH ERRORS, AND WE RESERVE THE RIGHT, IN THE EVENT OF SUCH ERROR, TO REMOVE ALL GAMES FROM THE RELEVANT SOFTWARE AND SITE AND TO TAKE ANY OTHER ACTION TO CORRECT SUCH ERRORS, PROVIDED THAT WE ARE NOT REQUIRED TO PROVIDE REPLACEMENT SOFTWARE AND/OR SIMILAR GAMES. WE WILL ALSO NOT BE LIABLE TO PAY ANY WINNINGS THAT WOULD HAVE BEEN OBTAINED OUTSIDE THE NORMAL COURSE OF THE GAME, I.E. IN PARTICULAR AS A RESULT OF A GAME SOFTWARE BUG, A PLATFORM BUG, THROUGH EMPLOYEE MISCONDUCT, THROUGH THE USE OF PIRACY SOFTWARE OR OTHERWISE, ALL SUCH WINNINGS WILL BE AUTOMATICALLY VOID.

PAC MAN SHALL NOT BE LIABLE FOR ANY ACT OR OMISSION ON THE PART OF YOUR INTERNET PROVIDER OR ANY OTHER THIRD PARTY WITH WHICH YOU CONTRACT IN ORDER TO BE ABLE TO ACCESS PAC MAN’S SERVICE AND/OR SOFTWARE. IN THE EVENT OF A DISPUTE BETWEEN THE INTERNET PROVIDER AND YOU, PAC MAN SHALL IN NO WAY BE BOUND BY LAWSUITS, AND SUCH DISPUTES SHALL IN NO WAY AFFECT THE USER’S OBLIGATIONS IN RELATION TO THE SPECIAL CONDITIONS OF THIS AGREEMENT.

7. INTELLECTUAL PROPERTY

The Player declares to be informed that PAC MAN owns or benefits from the rights relating to

all distinctive signs of the Site, the Software and the games offered on the Site.

The games and the Site are the property of PRODUWEB GAMING or other PAC MAN partners, which hold the exclusive rights thereto.

Access to and use of the games and the Site imply the use of data and programs that are not the property of the Player and on which PAC MAN grants him, in the name and on behalf of PRODUWEB GAMING, a personal, non-exclusive, temporary, revocable, and non-transferable license strictly limited to the non-commercial use of the games offered and this in strict accordance with the provisions of this Agreement. This license does not imply the granting of any other rights on the part of the Player, including any rights that the Player may claim as a result of the passage of time or the attitude of PAC MAN or PRODUWEB GAMING. The Player shall not grant any sublicense. The Player’s right of use is subject to the resolute condition that the Player does not comply with this Agreement.

Any use of the Games or the Site outside the Player’s legitimate and authorized connection to the Site is strictly prohibited.

The Player further agrees not to infringe in any way the above-mentioned intellectual property rights and, in particular, to reproduce, communicate, make use, even partially, of the distinctive signs, or make use of all or part of the content of the Software, games, the Site or any components of the Site, the Software or games that allow it to operate, without the prior written consent of PAC MAN and PRODUWEB GAMING.

The Player shall not copy, print, transfer, transmit all or part of the Software or games on any medium or in any form whatsoever; sell, rent, sublicense or distribute in any way the Software or games; modify the Software, Site or games, and/or merge all or part of the Software, Site or games into other computer programs; compile the Software, Site or games, decompile them, disassemble them, translate them.

The Player shall refrain from using robots, research programs or any other manual or automatic process that will allow him or her or any third party or other Player to index, store, record or reproduce, all or part of the content of the Site or the Game, or data relating to Players.

The Player further agrees not to, for example: (a) allow any person or persons to use the Site, Software or Games without PAC MAN’s prior consent; (b) reverse engineer, create derivative works from the Site, Software or Games; (c) use the Site, Software or Games for any purpose other than those described in this Agreement.

The Player agrees to delete all copies of the Site, the Software, the Site or the games in the event of unregistration, voluntary or at the initiative of PAC MAN, whatever the cause.

8. Penalty for non-compliance with the Contract or current laws

PAC MAN reserves the right to suspend or terminate its user account without notice or compensation in the event of non-compliance by the Player with the Contract or applicable law.

In particular, the following shall be considered as non-compliance justifying the suspension or termination of the user account:

Failure to comply with special conditions of registration; in particular, in the event that the special conditions of registration are not/are no longer fulfilled, or the information provided by the Player is not or is not more accurate/sincere/complete/current.

This will be the case if the Player is banned from playing.

Misuse of the account opening procedure;
Unauthorized use of the User Account by the Player, such as the use of user account by the Player as a bank account;
Misuse of bonuses, promotions and/or any other offers by PAC MAN;
Any fraud or unlawful Player activity, or attempted unlawful or unauthorized use by PAC MAN of the Site, Software or Games, including the use of another Player’s user account (even with their consent), or the use of stolen credit or debit cards, or money laundering activities;
Any acts of piracy of the Site, the Software or the Games, including the infringement of PAC MAN’s intellectual property rights;
Any violation of the rules of the game permanently accessible on the Site, and in particular in case of cheating (such as, for example, chip dumping or the use of automated software, ...);
Any acts or attempts to collide between players.

In the event of suspension or termination of a Player’s user account, PAC MAN reserves the right:

report to any competent authorities, including judicial authorities, electronic payment providers, or any other financial institution, any illegal or suspected activity on the part of a Player;
suspend or cancel any transaction, bet, wager or payment by or to any Player.
freeze Player assets to prevent the consequences of any suspected or proven misuse or illicit use of the Site or the Games;
initiate any necessary or useful legal action to put an end to the Player’s alleged breach, obtain compensation for the damage suffered by PAC MAN or recover any gain that may have been paid to the Player subsequently or as a result of the alleged breach.

In he t that a Player’s account is terminated by PAC MAN due to non-compliance with the Contract, the Player will be notified of the termination of his user account by sending an email to the address indicated when registering. Closure of the user account shall result in the loss of any winnings accumulated as a result of the wrongful non-performance of the Contract by the Player, without prejudice to PAC MAN’s right to recover any compensation due to it.

9. DURATION AND TERMINATION

9.1.

The Contract enters into force immediately after clicking on the “I accept” box. It will remain in effect until the Player’s user account is closed.

9.2.

The Player may terminate this Agreement at any time by registered mail to PAC MAN, Overbekeplein, 14/1, at 8500 Kortrijk (Belgium). Termination of the Contract will take effect when the Player has received written notification from PAC MAN that the Contract has been terminated.

9.3.

Without prejudice to PAC MAN’s right to terminate the User Account in accordance with Article 8 of the Agreement, PAC MAN is also entitled to terminate the Player’s User Account in the event that the Player remains inactive for a period of 12 months or more. Any positive balance in favor of the Player will be paid at the same time as the closure of the user account, without prejudice to his right to request a new registration.

9.4.

Without prejudice to the consequences of account termination, as described in Article 8, termination of the Agreement implies that the Player ceases all use of the Site, the Software and the Games and deletes any copies thereof from his computer or any other medium.

10. Other

10.1. ETHICAL AND RESPONSIBLE GAMBLING

10.2. CUSTOMER SERVICE AND COMPLAINTS

Except as otherwise provided in this Agreement, the Player undertakes to address any requests for changes to his personal details or to make any complaint or dispute to [email protected]. Complaints must be addressed no later than within 14 days of the original transaction. Failure to do so will render the complaint inadmissible.

In order to always optimize the quality of the Site, the Software and the games, all Player requests will be processed with all the necessary diligence. The Player declares, however, that PAC MAN is not obligated to investigate or act upon any complaint made by any Player against any other Player.

PAC MAN, in its sole discretion, may decide to act against any person suspected of unlawful action or want to violate the special conditions of this Contract.

However, PAC MAN has no obligation to Players to verify whether Players are using the Software, Site, Software or Games in accordance with the rules set forth in this Agreement. In no event shall PAC MAN’s failure to respond to a Player’s breach of any provision of this Agreement constitute a waiver of rights.

10.3. AMENDMENT OF THE CONTRACT

PAC MAN reserves the right to amend, modify, update this Agreement, including the rules of play.

The version of the Agreement posted on PAC MAN’s website(s) is the version in force and enforceable against all Players, with immediate effect for the future.

A notice of change with a closing date will be posted on the Site. PAC MAN therefore recommends that Players regularly review the text of the Agreement, or at least as soon as a notice of amendment to the Agreement is published by PAC MAN.

If the Player refuses to be bound by any changes to the Agreement, he agrees to immediately request the termination of his user account and to cease using the Site, the Software and the Games.

10.4. Keeping a printed version of the GTU

The Player is free to save or print this Agreement, provided that it is not modified.

In any case, the files, data and documents kept by PAC MAN on computer media, or by its potential partners, under reasonable special conditions of security, will be considered as proof of communications, the contract and any financial transactions occurred in performance thereof. The Parties shall recognize such evidence as having the same evidentiary value as they would recognize in a paper document. Emails stored in electronic format by PAC MAN will be authentic, even if the sender has not provided them with an electronic signature.

10.5. Severability

If one or more clauses of the Contract are declared invalid by law, regulation or final decision of a court, the Parties agree to replace it with a valid clause of equivalent effect.

Furthermore, they agree that invalidity of any provision of this Agreement shall not affect

not the validity of the other provisions of the Contract which will retain their full effects.

10.6. Assignment of contract

Player’s rights and obligations may not be assigned to a third party, Player or not, without the consent of PAC MAN.

The Player declares to be informed PAC MAN, and authorizes PAC MAN, to sell the Software, the Site or all or part of the games without its prior consent. In this case, PAC MAN will notify the Players in advance and ensure that the guarantees offered by the third-party buyer are not less than those offered to it by PAC MAN.

10.7. Predominance of the French version

In the event of discrepancies between the French and Dutch versions of the contract, the French version shall prevail.

THIS CONTRACT IS CONSIDERED VALIDLY CONCLUDED, ACCEPTED AND SIGNED BY PAC MAN AND THE PLAYER OF THE MOMENT OR THE PLAYER HAS, AS INDICATED IN ARTICLES 4 AND 5 OF THE CONTRACT, CLICK ON “I HAVE READ AND ACCEPT THIS CONTRACT”.

10.8. Applicable law and competent jurisdiction

This Agreement is subject to Belgian law, without prejudice to the mandatory provisions that the Player would be entitled to enforce pursuant to Article 6 of EC Regulation No 593/2008 of the European Parliament and of the Council on the law applicable to contractual obligations.

The Parties undertake, in the event of a dispute, to attempt to settle the dispute amicably within 14 days, starting from the date on which it is denounced by one of the Parties. Failing an amicable settlement within the above-mentioned period, the Belgian courts of the judicial district of Liège shall have exclusive jurisdiction to settle any dispute relating to its formation, execution or interpretation.
